Proof of sending (such as an automated computer receipt confirming delivery of email, "thanks for entering" message or post office receipt) does not constitute proof of actual receipt by Sponsor of an entry for purposes of these Official Rules. Automated entries (including but not limited to entries submitted using any bot, script, macro, or sweepstakes service), copies, third party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified. Only eligible entries actually received by Sponsor before the end of the specified entry period will be included in the prize drawing. Entries which are fraudulent, unintelligible, incomplete, garbled or otherwise do not conform to the requirements of these Official Rules will be disqualified. All entries become the property of Sponsor and none will be acknowledged or returned.
PRIZES: One Hundred (100) Camouflage Hats (ARV $10 each); Ten (10) Camouflage Marksman Jackets (ARV $90 each) and Ten (10) Grainger Alkaline Battery Kits (ARV $126 to $176 depending upon the size). Prizes are not transferable and must be accepted as awarded. Prize substitutions will not be allowed; except, Sponsor at its sole discretion may substitute prizes of comparable value for the advertised prizes due to prize unavailability for any reason. Limit one prize per person regardless of e-mail address used. Sponsor is not responsible if prizes are lost, stolen or mutilated and the prizes will not be replaced. No exchange for cash will be permitted and no refunds are allowed. The value of the prizes may be taxable as income; winners are responsible for any applicable taxes. All taxes, fees, and surcharges on the prizes are the sole responsibility of the winners. The winners must agree to provide required personal information to Sponsor in order to generate tax documents, if required. The winners agree to indemnify and hold harmless Sponsor and its employees and agents from and against any liability for such taxes.
WINNER SELECTION: One hundred twenty (120) prize winners will be selected in a random drawing on or about March 2, 2009, from all eligible entries received. The drawings will be conducted by the contest judges (who may be employees or independent contractors of the Sponsor or its promotional agents), (the "Judging Organization") whose decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning will depend upon the number of eligible entries received. Winners will be notified by telephone or e-mail. Any difference between actual value of a prize and the approximate value of a prize as stated in these Official Rules will not be awarded.
GENERAL CONDITIONS: By entering the Sweepstakes, participants agree to these Official Rules (which are subject to change without notice) and the decisions of Sponsor and the Judging Organization. All decisions of the Judging Organization with respect to any and all aspects of the Sweepstakes are final and binding, without right of appeal. Sponsor, the Judging Organization and their agencies, their respective parents, subsidiaries, affiliates and the officers, directors, agents and employees of any of the foregoing entities are not responsible or liable for: (1) garbled, illegible, incomplete, damaged, misdirected, late, lost or failed electronic entries; (2) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties of any kind, including but not limited to failure of any e-mail entry to be received by Sponsor; (3) errors or delays in transmission; (4) any condition caused by events beyond the control of the Sponsor which may cause the Sweepstakes to be disrupted or corrupted; (5) any losses, damages, or any injuries caused directly or indirectly by the acceptance or use of the prize or from participation in the Sweepstakes; (6) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor and the Judging Organization may disqualify any participants at their sole discretion if any participants show a disregard for the Sweepstakes or Official Rules, or if participants act: (a) in a manner they determine to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor; (c) in any other disruptive manner; or (d) in violation of the Spectrum Brands Privacy Policy and Terms & Conditions of Use at http://grainger.rayovacindustrial.com. The names, addresses and any other personal information obtained from the Sweepstakes participants in connection with the Sweepstakes (the "Participants’ Information") will be used in connection with the administration of the Sweepstakes, including without limitation for the purpose of selecting and contacting the winners and where required by applicable law, posting the names and addresses of the winners.
In addition, unless participants opt out by clicking the "Opt Out" icon on the http://grainger.rayovacindustrial.com website at the time they enter the Sweepstakes, participants understand and agree that Grainger may without compensation or acknowledgement, use the Participants’ Information for among other things, to notify participants of new products, for all other legitimate business purposes of Grainger and in accordance with Grainger’s privacy policy (which can be found at http://www.grainger.com/Grainger/items/2LBK5).
Sponsor reserves the right in its sole discretion to cancel, terminate or suspend this Sweepstakes should electronic viruses, other malicious software attacks, unauthorized human intervention, systems malfunctions, failures, difficulties or other causes beyond the control of Sponsor and its agencies corrupt or affect the administration, security, fairness or proper play or conduct of the Sweepstakes. In such event, for all affected drawing(s), the winner will be selected in a random drawing from among all eligible online entries received for such affected drawing(s) prior to and/or after (as appropriate) the action taken by Sponsor. In such event, notice will be posted on http://grainger.rayovacindustrial.com. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by applicable law.
By accepting a prize, each prize winner consents to the use of his/her name and address and his/her/ likeness for: (a) posting in compliance with applicable law and (b) advertising/ publicity/trade, Internet and promotional purposes, all without further compensation, except where prohibited by law. By entering this Sweepstakes, entrant agrees to release and hold harmless, Sponsor, and any promotional partners, the Judging Organization, each of their related companies, and each of their respective officers, directors, employees, and agents (collectively the "Released Parties") from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Sweepstakes or resulting directly or indirectly, from acceptance, possession, use or misuse of any prize or resulting directly or indirectly, from acceptance, possession, use or misuse of the benefit of any prize awarded in connection with the Sweepstakes, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy. The Sweepstakes is subject to all applicable federal, state and local laws.
ELIGIBILITY: Employees and agents of Sponsor and its affiliates, advertising, promotional, and official judging agencies, distributors/wholesalers, retailers, their immediate families (parents, siblings, children, spouse) or those living in the same household of each are not eligible to enter or win.
